LIABILITY DISCLAIMER POLICY

At The MBassy Dance, the safety and well-being of our clients are of utmost importance to us. While we strive to provide a safe and secure environment for all participants, we want to make it clear that we are not liable for any loss, damage, or injury that may occur to personal property or individuals during our dance classes, workshops, events, or performances. Please review our liability disclaimer policy outlined below:

Personal Property
Clients are responsible for their personal belongings brought onto our premises. The MBassy Dance and its staff are not liable for any loss, theft, or damage to personal property, including but not limited to clothing, accessories, electronic devices, or valuables left unattended. Lost items will be held for no more than 72 hours.

Injury
Participation in dance activities involves inherent risks, including the risk of injury. While we take precautions to minimise these risks, clients acknowledge and accept the inherent risks associated with dancing. The MBassy Dance and its staff are not liable for any injuries sustained by clients during our classes, workshops, events, or performances.

Safety Measures
We maintain safety protocols and guidelines to minimise the risk of injury during dance activities. Clients are expected to follow instructions from our instructors and adhere to safety guidelines at all times. Clients with pre-existing medical conditions or injuries should consult with a healthcare professional before participating in dance activities.

Communication and Data Processing Permission
The use of our brand's or brand participants' personal contact information, including phone numbers, email addresses, and social media accounts, without permission from our brand or the individuals you are contacting, is strictly prohibited. This is non-negotiable and inflexible. This includes phone calls, video or written content, and voice recordings. Any breach of this may result in legal action. If contact with and/or services with our brand are declined and there is continued contact through physical or digital harassment, legal action may be taken.

Parental Responsibility
Parents or legal guardians are responsible for the safety and supervision of minors participating in our programs. Parents or legal guardians must ensure that minors understand and adhere to safety guidelines and instructions provided by our staff.

Staff Conduct
Our staff are trained professionals dedicated to ensuring a safe and enjoyable experience for all clients. However, The MBassy Dance and its staff are not liable for any accidents, injuries, or damages that occur as a result of client negligence, misconduct, or failure to follow instructions.

Agreement
By participating in any activities at The MBassy Dance, clients acknowledge and accept the terms of this liability disclaimer policy. Clients agree to waive any claims against The MBassy Dance and its staff for loss, damage, or injury arising from participation in our programs.

PHOTOGRAPHY & FILMING POLICY

At The MBassy Dance, we capture photos and videos during our dance classes, workshops, events, and performances. These images may be used for promotional purposes in print materials, on our website, and on our social media platforms. Please review our photography and filming policy outlined below:

Consent
By participating in any activities at The MBassy Dance, you consent to being photographed or filmed. We respect your privacy and will not use any images or footage that compromise your dignity or depict you in a negative light.

Usage
Photos and videos captured by The MBassy Dance may be used for promotional purposes, including but not limited to advertising, marketing materials, website content, and social media posts. These materials may be distributed and displayed publicly without compensation to you.

Opt-Out
If you prefer not to be photographed or filmed, please inform our staff or the photographer/videographer before the start of the session or event. We will make reasonable efforts to accommodate your request, although we cannot guarantee that you will not be inadvertently included in group shots or crowd scenes.

Minors
For participants under the age of 18, we require explicit consent from a parent or legal guardian before using any photos or videos featuring them for promotional purposes. Parents or legal guardians have the right to opt-out their children from being photographed or filmed.

Professionalism
Our staff and hired photographers/videographers will conduct themselves in a professional manner when capturing images or footage. We will strive to ensure that photography and filming activities do not disrupt the enjoyment or safety of our clients.

Ownership
The MBassy Dance retains ownership and copyright of all photos and videos captured during our activities. Clients do not have the right to claim ownership or reproduce these images or footage without prior written consent from The MBassy Dance.

Virtual Video Access
Access to the videos is available for 7 days starting from the first day of your class. After 7 days, you will no longer have access to the videos. It may take 24-48 hours for the videos to be available to you after the class, due to the transfer process. Video links are sent via email and third-party software is used; if you are unable to access the videos due to software issues, please contact us within 24 hours. Otherwise, you may not be granted access to the videos and our brand is not responsible for this. It is prohibited to share our lesson content and choreography with third parties or organizations without permission.

Sharing
We encourage clients to share their own photos and videos from our classes and events on their personal social media accounts. However, we request that clients tag The MBassy Dance and give credit when sharing content created by our studio.

SERVICE REFUSAL POLICY

At The MBassy Dance, we strive to create a safe, inclusive, and positive environment for all our clients. While we aim to accommodate the needs of every individual, there may be rare circumstances where we reserve the right to refuse service. Please review our service refusal policy outlined below:

Discriminatory Behaviour
We do not tolerate any form of discrimination, harassment, or disrespectful behavior towards our staff or other clients. Any individual who engages in discriminatory behavior, including but not limited to discrimination based on race, ethnicity, gender, sexual orientation, religion, age, or disability, will be refused service.

Intoxication or Impairment
For the safety of our instructors and other clients, individuals who arrive under the influence of drugs or alcohol will be refused service. If an individual's behaviour poses a risk to themselves, others, or the integrity of our facility, we reserve the right to refuse service.

Violation of Studio Policies
Clients who repeatedly violate our studio policies, including but not limited to disruptive behaviour, failure to adhere to safety guidelines, or non-compliance with payment terms, may be refused service. We expect all clients to respect our studio policies and guidelines to ensure a harmonious and productive environment for everyone.

Failure to Meet Prerequisites
Some sessions may require certain prerequisites or skill levels to participate safely and effectively. If an individual does not meet the prerequisites for a particular session and their participation poses a risk to themselves or others, we reserve the right to refuse service.

Instructor Discretion
Our instructors have the authority to refuse service to any individual if they believe it is necessary to maintain a safe and productive learning environment. Instructors will exercise their discretion with professionalism and fairness, taking into account the well-being and comfort of all participants.

Intellectual Property
All content created by The MBassy Dance, including but not limited to choreography, instructional materials, videos, images, logos, and any other media produced by our staff and/or representatives, is the intellectual property of The MBassy Dance. Unauthorized reproduction, distribution, or use of our intellectual property without express written permission is strictly prohibited.

Clients or any individuals found reproducing or distributing our intellectual property without authorization will be denied service and may be subject to legal action. The MBassy Dance reserves the right to pursue all available legal remedies to protect our intellectual property rights.

Prohibition of Solicitation
The MBassy Dance maintains a professional and respectful environment for all clients and participants. Any individual found soliciting or promoting their own business, services, or products to our clients during events, classes, or on our premises without prior authorisation will be subject to immediate refusal of service.

The MBassy Dance reserves the right to take appropriate action to ensure the integrity of our community and the experience of our clients. Unauthorized solicitation or promotion is strictly prohibited, and violators may be asked to leave the premises and denied future services.

Right to Refuse
The MBassy Dance reserves the right to refuse service to any individual whose conduct or behaviour is deemed incompatible with our values, policies, or the well-being of our staff and clients.
If a situation arises where service refusal is deemed necessary, our staff will handle the matter with sensitivity and professionalism. Individuals who are refused service will be provided with an explanation for the decision, and if appropriate, guidance on how to address the issue.

CANCELLATION POLICY

Client Cancellations
All cancellations must be made via email with as much notice as possible. No cancellations are eligible for refunds.

Refunds
We do not offer refunds for canceled sessions under any circumstances.

Transfers
Session transfers are not permitted. Once a session is scheduled, it cannot be transferred to another individual or rescheduled for a different date or time.

No-Shows
If you fail to attend a scheduled session without prior notification or cancelation, it will be considered a "no-show." No-shows are not eligible for refunds or credits.

Emergencies
In the case of a genuine emergency that prevents you from attending your scheduled session, please contact us as soon as possible. We will review these situations on a case-by-case basis.

Communication
All cancellations must be communicated directly to The MBassy Dance via email. Cancellations made verbally, via social media, or any other means, will not be considered valid.

Studio Cancellations
In the unlikely event that we should need to cancel a scheduled lesson, we will notify you as soon as possible. If a lesson is canceled by The MBassy Dance, we will offer you the option to reschedule the session or receive a credit towards future sessions. 

Our Timetable
The MBassy Dance reserves the right to make changes to our group class and workshop timetable as deemed necessary.

Privacy Policy

The MBassy Dance is committed to providing quality services to you, and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

What is Personal Information and why do we collect it?
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include names, addresses, email addresses, and phone numbers.

This Personal Information is obtained in many ways including interviews, correspondence, by telephone, by email, via our website www.thembassydance.com.au, from media and publications, from other publicly available sources, and from cookies. We don’t guarantee website links or policy of authorized third parties.

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients, and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Sensitive Information
Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record, or health information.

Sensitive information will be used by us only:

  • For a secondary purpose that is directly related to the primary purpose

However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

The MBassy Dance will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information, we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information
It is important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete, and up-to-date. If you find that the information we have is not up-to-date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.
